pages 79-80     Articles of Agreement: 7 Dec. 1820, John Barton, admr. of James Barton, decd., Henry Casey in right of his wife, Thomas Barton, David Barton, Fanny Barton, Susan Barton, Patsey Barton, Evelina Barton, & John W. Barton, legatees of James Barton, decd. Fanny, Susan, Patsey, Evelina, & John W. Barton are infants & represented by their father, guardian, & next friend, all of Morgan Co. of the one part, & Richard Wiatt Oats the father of Mary Barton the widow of James Barton, decd. in behalf & jointly with his daughter, Mary. Oats of Clark Co., Ga., & Mary Barton of Morgan Co., Ga. John Barton as admr. & representative of his children & legatees under age, Henry Casey in right of his wife, Thomas Barton, & David Barton in their own right, & Richard Wiatt Oats for his daughter Mary Barton for & on behalf of himself, have come to an agreement to compromise all disputes & lawsuits between the two parties respecting distribution of the estate of James Barton, decd. Estate is to be divided by agreement: all property given to Mary Barton or part to possession of James Barton, late her husband, by Richard Wiatt Oats, father of Mary, is to be returned to Mary as her property & all property given to James Barton or put in possession of James by John Barton, his father, is to be returned to John Barton as admr. & in right of his children under age, & the other legal heirs: Henry Casey in right of his wife, Thomas Barton, & David Barton, & all balance of estate of James Barton, decd. acquired by him during his coveture with his wife, Mary, after payment of all debts & expenses on management & distribution of estate to be equally divided between the two parties. First division & distribution is to be made by persons named with full powers as referees to make same & the parties first in the rights appoint John Butler, Sterling Ammons, William Buford, & Thaddeus Beall to settle & distribute estate of James Barton, decd. & all other differences which may arise between the two parties respecting distribution of estate & their award shall be binding on all parties as fully as if the distribution was made under an order of a Court of Ordinary for true performance. The award by the referees shall be binding on the two parties each jointly bound for $10,000. /s/ Rc. W. Morris, Clevers (x) Brooks, Griffith (x) Campbell. Morgan Co.: 7 Dec. 1820 by Articles of Agreement with this award, John Butler, Sterling Ammons, William Buford, & Thaddeus Beall, referees, agree that negroes Buck & Abby shall be the property of Mary Barton, widow of James Barton, decd. Negro Franky to the children of John Barton as the legatees of James Barton. All other property of every description belonging to the estate of James Barton after payment of debts & expenses to be equally divided between the children of John Barton as the legal heirs of James Barton, decd. & Mary Barton, widow of decd. /s/ John M.
